Introduction
The course aims to provide participants with an understanding of Intellectual Property (IP) laws, the requirements of the IP8001 Standard for IP protection, matters regarding copyrights, trademarks, patents and so forth, and the procedures of compliance management and auditing, in order to conduct audits for companies intending to apply for the IP8001 certification.

Demand for IP Auditor

There is a growing demand for legal protection for intellectual property (IP) worldwide. Companies which do not conform to the legal requirements of IP will expose themselves to business risks, including fines, loss of goodwill and lawsuits.

Compliance with IP laws and regulations is probably the most common driver of IP audits. The fee an IP auditor charges can be anywhere from US$2,000 to US$25,000 per site, depending on the size and nature of the business.

A registered IP Auditor who has expertise in completing such an assessment will be in high demand in the knowledge based economy.

What is the IP8001 Standard?

The IP8001 Standard is the first of the KM8000 series of certification standards specifying the requirements of a compliance management system for the protection of intellectual properties of an organisation including from third parties.

The Standard is accredited by the Professional Validation Council of Hong Kong Industries (PVCHK).

Companies awarded with the IP8001 certification will be listed on our website and will be searchable by local and overseas customers who are looking for a reliable company to handle their IP.

The IP8001 Certification Scheme

The IP8001 certification scheme is operated by AKMA and accredited by the Professional Validation Council of Hong Kong Industries (PVCHK). PVCHK, an independent professional accreditation body, was formed by more than 30 trade associations and industries in Hong Kong in 1999.

Companies which have set up the IP8001 Intellectual Property Management System present a unique opportunity for IP auditing. AKMA, being a certification body, may require a great deal of Registered IP Auditors for carrying out the certification audits. It is expected that some 5,000 companies will apply for IP8001 Standard certification in the next 3 years and IP auditors with training in this Standard will therefore be in high demand.

Modules and Structure

The programme requires a total of 36 hours of lectures. All training materials will be provided by AKMA. The following is an outline of the modules that constitutes the body of knowledge for a Certified IP Auditor.

KM1010 Intellectual Property Management System
Legal requirements of IP protection; Liabilities and claims; Framework of a compliance management system; Requirements of the IP8001 Standard; Compliance management system planning; Operational control; System documentation; Compliance auditing and corrective actions.

KM1020 Legal Aspects of Intellectual Property*
Overview of IP Laws; Copyright protection; Patent Laws; Registered designs; Legal procedures in HK and other countries and Infringement actions in HK.

KM1030 Compliance Management and Auditing
Legal requirements and compliance Register; Types of compliance auditing; Requirements of IP8001 Standard and auditing; General principles of compliance auditing; Audit plan and procedures and Audit report.

* Practitioners with 5 years' IP experience or more may be exempted from this module.

Certification Examination

The certification examination is managed by AKMA and the examination date will be announced one month in advance. The examination consists of multiple choice questions only. There is no limit to the number of times for retaking the examination. Candidates who pass the examination are entitled to use the Certified IP Auditor designation, which is only a stage in the professional development for registration**.

**Candidates who pass the examination are also qualified as Certified IP Consultant and may carry out a work-based consultancy project for registration.

Registration Process

Participants who have passed the examination become Certified IP Auditors. Upon successful completion of one auditing assignment to a real-life company arranged by AKMA, they may apply for registration with AKMA or PVCHK, on presentation of the following documents:

  • An up-to-date CV
  • Evidence of academic and professional qualifications
  • Documentation regarding the auditing assignments
  • Evidence of completing a work-based project (i.e. a IP8001 auditing assignment)
  • To maintain the registration status, all practitioners must maintain the interest and knowledge in compliance auditing through our Mentoring Scheme. The purpose of this Mentoring Scheme is to help a Certified IP Auditor to obtain the professional experience in the IP8001 auditing assignment. Evidence of this Mentoring Scheme must be submitted for registration renewal within 2 years after registration.
